TREE Furniture and Accessory Rental Agreement/ Terms of Service

1. Primary Customer Contact:

All customers who place an order with TREE Furniture & Accessory Rental (TREE) will be the primary contact. Every customer must authorize the rental agreement prior to processing their order with their credit card. Any damages incurred by the end user are the responsibility of the customer who enters into the agreement.

2. Payment, Pricing & Renewal:

TREE accepts payment by credit card (VISA & MasterCard) through the order form on the TREE website. All payments are secure and TREE does not keep Credit Card numbers on file or in the system.

The rental items, rental periods, and scheduled delivery & pick-up dates verified on the rental agreement are guaranteed by TREE Furniture & Accessory Rental. If a customer wishes to extend their rental period, it is advised that the customer call at their earliest convenience to ensure the items are available and have not been promised to another customer. The customer acknowledges that TREE cannot guarantee that the same items will be available for renewal and a new “packaging fee” will be charged should items need to be substituted (at the originally scheduled pick up date) for the renewal period. Please note that the “packaging fee” is based on the number and size of items to be substituted.

3. Cancellations:

Cancellations of any orders must be made a minimum of 48 hours in advance of the scheduled delivery date. Customers must call TREE during regular business hours to cancel. Customers acknowledge that they will be charged a $150.00 cancellation fee upon cancellation. Customers who make last minute cancellations (within 48 hours of scheduled delivery date) will be refunded 50% of the initial cost of the total order fee charged to their credit card.

4. Delivery:

TREE has no minimum order for delivery. Delivery of the rented furniture and accessories can be done by TREE’s company personnel only.

The customer or customer’s representative must be present at the delivery address on the date requested. TREE delivery personnel will call the customer the day before to advise the customer of the time slot allotted for delivery. The customer or their representative must fully inspect the delivered furniture to ensure that all items are in good condition. The customer or customer’s representative will be required to acknowledge receipt of the rented items by signing the delivery receipt.

Customers must make all necessary arrangements prior to any delivery and or pick-up. This includes arranging parking, safe work environment, booked elevators, etc. Any larger rented furniture items will be placed in the required rooms by TREE delivery personnel. Please ensure that the customer or customer’s representative receiving delivery is aware of which rooms the larger items are to be placed. The customer agrees to have the rooms prepared for delivery of larger items. The customer acknowledges that TREE personnel will not move any items owned by the customer or end user. If rooms are not prepared for delivery, TREE personnel will place larger furniture items in the hallway on the requested floor and the customer acknowledges that the customer will be held responsible for any damages made to the furniture by the customer (or end user) upon placement after the delivery slip is signed.

Delivery drivers will contact the customer if they are not able to meet the scheduled time slot for delivery or pick-up due to traffic or weather delays.

The rented property shall not be removed from the address it has been delivered to without TREE’s written consent. If the customer requests a transfer of the furniture to a different address (during the specified rental period), a minimum transfer fee of $500 will be charged.

If the customer misses the scheduled delivery date the customer acknowledges that an additional $150 delivery charge will be charged upon rescheduling.

If the customer wishes to change the delivery date as agreed on the order form, the customer must provide a minimum of 5 business days notice or additional delivery charges will apply. TREE cannot guarantee the customer’s new requested delivery date however all efforts will be made to accommodate the customer’s request.

TREE Delivery personnel will handle only the furniture rented from TREE. Delivery personnel are not insured to move or handle furniture belonging to the homeowner, staging professional or another third party.

5. Pick-up:

The customer or customer’s representative must be present at the pick-up address on the date specified for pick-up. TREE delivery personnel will call the customer the day before to advise the customer of the time slot allotted for pick-up. All items should be returned to TREE in the same condition as they were received. The customer or customer’s representative will be required to acknowledge the condition of the items by signing the pick-up receipt.

Customers must make all necessary arrangements prior to any delivery and or pick-up. This includes arranging parking, safe work environment, booked elevators, etc. Delivery drivers will contact the customer if they are not able to meet the scheduled time slot for delivery or pick-up due to traffic or weather delays.

If the customer misses the scheduled delivery date the customer acknowledges that an additional $150 delivery charge will be charged upon rescheduling.

If a customer would like to request early return of rental items, a minimum of 2 business days (48 hours) notice is required to reschedule the pick-up date by TREE personnel. Please call during business hours to reschedule your pick-update. The customer will not be entitled to a refund of any portion of the rent for the contracted rental period for any items returned early.

TREE delivery personal is not responsible for returning any of the homeowners existing furniture to its original placement. If this is required it will be arranged before the contract is agreed to and a fee will apply.

6. Return of Rental Items and Packaging:

Upon termination of the agreement for any reason whatsoever, the customer shall have all rental items ready for pick up on the assigned date and will prepare accessories for transit. Return of the rented items shall be in clean and in as good condition as when received. The customer will be responsible for returning and re-applying original packaging to all accessories. Return of all bins, moving blankets and/or any additional moving supplies originally provided will also be expected. Failure to have accessories returned in original packaging or packaged in same method as received will result in an additional surcharge. TREE personnel will be responsible for packaging only large furniture items on pick-up.

7. Damage or Loss to Furniture and Accessories:

The client acknowledges and agrees that the furnishings listed on their order are owned and rented by TREE Furniture & Accessory Rental for the sole purpose as indicated on their order form. It is the customer’s responsibility to ensure their order is correct and to report any discrepancy or issue with the order at the time of delivery and prior to signing the delivery slip.
In case of breakage, tear, or any other damage incurred by the customer (or end user) during the rental period the customer acknowledges that they will be required to cover the cost of cleaning, repair, or replacement of the damaged items. TREE will charge the customer by invoice and the customer agrees to pay for the cost of replacing each damaged, lost, or stolen item at the rate of 10 times the monthly rental rate.

TREE loves pets however removal of animal hair requires additional cleaning time and expense therefore a monetary surcharge of $25-$50 will be applied to upholstered furniture pieces and/or area rugs which are returned with animal hair.

8. Insurance:

The customer acknowledges that the customer (or end user) is responsible to obtain or maintain their own personal property loss insurance and hereby assumes all liability for the cost of repairing or replacing any damaged, lost, or stolen piece of TREE’s rented furniture/accessories while in their care, custody and control.

9. Maintenance and Care:

The maintenance and care of rented TREE property is the responsibility of the customer. The customer hereby assumes covering costs for any cleaning, repair or replacement resulting from loss, breakage, unreasonable or excessive wear or any other damage of furniture/accessories while in the customer’s care, custody and control. Replacement cost of each item is 10 times the monthly rental rate. If the customer chooses to clean property owned by TREE while in their possession, please only use a dry dust cloth on wood items, only glass cleaner on mirrored and glass items and only natural non-abrasive spot cleaners on any fabrics. If you are not sure of what products are permitted, please contact TREE before usage.

10. Release and Waiver (Assumption of Risk):

Customer (and end user) acknowledges and agrees that TREE Furniture & Accessory Rental is not liable for any personal injury or property damage during installation, use, and/or removal of the furnishings and accessories. Customer (and end/user) acknowledges and agrees that installation of mirrors, artwork, wall hangings, and placement of other furnishings during the staging process may require fastening hooks and/or nails to be placed in the walls or property. Furnishings dragged, pushed or not moved properly may also cause damage to floors and walls. Upon removal, small holes and minor damage may be left. Touch-up work on these is the responsibility of customer.

Furthermore, the customer (and end user) acknowledges and agrees that TREE Furniture & Accessory Rental is not responsible for any personal injury or property damage incurred by any Trade or Staging professional contracted through our website.

11. Hold Harmless:

The customer further agrees to release, indemnify, and hold harmless TREE Furniture & Accessory Rental, its officers, employees, agents, contractors, and suppliers against any and all losses, accidents, liabilities, damages, injuries, expenses, and claims resulting in whole or part, directly or indirectly, from the services provided by TREE Furniture & Accessory Rental.

General Provisions:

This Agreement shall be governed by the laws of the Province of Ontario. This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written.
